Zgodnie z art.13 ust.1 i 2 Rozporządzenia Parlamentu Europejskiego i Rady (UE) 2016/679 z dnia 27 kwietnia 2016 r. w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych i w sprawie swobodnego przepływu takich danych oraz uchylenia dyrektyw 94/46 WE (dalej zwane RODO) w związku z pozyskaniem Twoich danych informujemy że:

  1. Pragniemy poinformować, że Twoje dane osobowe będą przez nas przetwarzane w następujących celach:
    • Przeprowadzenia procesu rekrutacyjnego, na które aplikujesz
    • Przeprowadzenia przyszłych procesów rekrutacyjnych, jeżeli wyraziłeś zgodę,
  2. Podstawą prawną przetwarzania Twoich danych jest :
    • obowiązujące przepisy prawa a więc art.221 Kodeksu pracy, który upoważnia nas do przetwarzania Twoich danych w celu zawarcia umowy o pracę w zakresie takich danych jak: Twoje imię (imiona) i nazwisko, imiona rodziców, data urodzenia, miejsce zamieszkania (adres do korespondencji), wykształcenie, przebieg dotychczasowego zatrudnienia (podstawa prawna Art. 6 ust.1 lit. c RODO);
    • Twoja zgoda -jeśli w swoim CV, ofercie pracy lub liście motywacyjnym przekazujesz nam inne dane niż wymienione w pkt 1 powyżej (np. przekazujesz nam swój wizerunek, adres e-maila lub numer telefonu komórkowego) bądź proces dotyczy innej formy zatrudnienia lub decydujesz się na proces weryfikacji danych w tym m.in. przeszłości zawodowej, to podstawą przetwarzania przez nas tych danych będzie Twoja zgoda (podstawa prawna Art. 6 ust.1 lit. a RODO);
    • Prawnie uzasadniony interes Administratora – w trakcie procesu rekrutacji możemy być zainteresowani przeprowadzaniem z Tobą rozmowy kwalifikacyjnej. Mamy uzasadniony interes w tym, aby wykorzystując dane pozyskane w trackie takiej rozmowy kwalifikacyjnej sprawdzić Twoje umiejętności i zdolności i ocenić czy jesteś odpowiednią osobą na stanowisko, na które poszukujemy pracownika oraz przeprowadzenia działań statystycznych badających zainteresowanie kandydatów wskazanym w ogłoszeniu stanowiskiem (podstawa prawna Art. 6 ust.1 lit. f RODO).
  3. Twoje dane osobowe będą przez nas przetwarzane przez okres 12 miesięcy od dnia zakończenia rekrutacji na stanowisko, na które aplikujesz. Jeśli natomiast wyrazisz zgodę(może to uczynić np. przesyłanym nam CV) na to aby Twoje dane będą przetwarzane również dla potrzeb ewentualnych przyszłych rekrutacji wówczas Twoje dane będą przez nas przetwarzane przez okres 10 lat lub do czasu wycofania zgody.
  4. Odbiorcą danych osobowych będą pracownicy i współpracownicy Administratorów w zakresie swoich obowiązków służbowych na podstawie upoważnienia  oraz podmioty współpracujące, które wspierają Administratorów przy realizacji celu- podmioty takie przetwarzają Twoje dany na podstawie zawartej z nami umowy i tylko zgodnie z naszymi poleceniami, zgodnie z wymogami art. 28 RODO. Dane osobowe mogą być również udostępnianie podmiotom do tego upoważnionym na podstawie przepisów prawa. W przypadku zgody na udział w przyszłych procesach rekrutacyjnych, Administratorzy będą uwzględniali Twoją kandydaturę w innych rekrutacjach, które prowadzą- przyszłych i prowadzonym równolegle. W przypadku, gdy rekrutacja prowadzona jest w imieniu innego podmiotu, Twoje CV może zostać udostępnione podmiotowi trzeciemu, jednak tylko za Twoją zgodą.
  5. Pragniemy poinformować Ciebie, że w związku z przetwarzaniem przez nas Twoich danych posiadasz prawo dostępu do treści swoich danych osobowych a także prawo ich sprostowania, usunięcia, ograniczenia przetwarzania, a także prawo do przenoszenia danych osobowych oraz prawo wniesienia sprzeciwu odnośnie przetwarzania Twoich danych. W takim zakresie, w jakim przetwarzamy Twoje dane na podstawie Twojej zgody – masz prawo wycofać zgodę na przetwarzanie danych w dowolnej chwili, z tym, że pozostaje to bez wpływu na zgodność z prawem przetwarzania danych, którego dokonaliśmy na podstawie zgody przed jej cofnięcie. Zgodę możesz wycofać poprzez oświadczenie o wycofaniu zgody wysłane na nasz adres korespondencyjny lub na nasz adres e-mailowy podanym w pkt.7

  8. W razie gdybyś uznał, że przetwarzanie Twoich danych osobowych narusza przepisy RODO, masz prawo do wniesienia skargi do Prezesa Urzędu Ochrony Danych Osobowych.

Podanie przez Ciebie danych osobowych w zakresie wynikającym z przepisów Kodeksu Pracy jest obligatoryjne a w pozostałym zakresie jest dobrowolne i wynika z faktu wyrażenia przez Ciebie zgody na przetwarzanie danych. Konsekwencje niepodania prze Ciebie danych będzie brak możliwości udziału w procesie rekrutacji na stanowisko, na które aplikujesz.
  10. Twoje dane osobowe nie będą przekazywane do państw trzecich lub organizacji międzynarodowych.
  11. Twoje dane nie będą przetwarzane w sposób zautomatyzowany w tym również w formie profilowania tzn. żadne decyzje wywołujące wobec osoby skutki prawne lub w podobny sposób na nią istotnie wpływające nie będą oparte wyłącznie na automatycznym przetwarzaniu danych osobowych i nie wiążą się z taką automatycznie podejmowaną decyzją.  

Information Clause for Candidates

Pursuant to Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 94/46/EC (hereinafter referred to as the GDPR), in connection with the acquisition of your data, we hereby inform you as follows:

  1. Your personal data will be processed by us for the following purposes:
    • Conducting the recruitment process for which you are applying;
    • Conducting future recruitment processes, provided you have given your consent.
  2. The legal basis for processing your data is:
    • Applicable provisions of law namely Article 22¹ of the Polish Labour Code, which authorises us to process your data for the purpose of concluding an employment contract within the scope of such data as: your name(s) and surname, parents’ names, date of birth, place of residence (correspondence address), education and employment history (legal basis: Article 6(1)(c) of the GDPR);
    • Your consent – if, in your CV, job application or cover letter, you provide us with data other than those listed in point 1 above (e.g. your image, e-mail address or mobile phone number), or if the process concerns another form of employment, or if you decide to undergo a data verification process, including, among others, verification of your professional background, the legal basis for our processing of such data will be your consent (legal basis: Article 6(1)(a) of the GDPR);
    • The legitimate interest of the Controller – in the course of the recruitment process, we may be interested in conducting a job interview with you. We have a legitimate interest in using the data obtained during such an interview to assess your skills and abilities and to evaluate whether you are a suitable person for the position for which we are recruiting, as well as in carrying out statistical activities analysing candidates’ interest in the position indicated in the job advertisement (legal basis: Article 6(1)(f) of the GDPR).
  3. Your personal data will be processed by us for a period of 12 months from the date of completion of the recruitment process for the position to which you are applying. If, however, you give your consent (which you may do, for example, by means of the CV submitted to us) for your data to also be processed for the purposes of potential future recruitment processes, your data will be processed by us for a period of 10 years or until your consent is withdrawn. 
  4. The recipients of your personal data will be the Controllers’ employees and associates, within the scope of their official duties and on the basis of an authorisation, as well as cooperating entities that support the Controllers in achieving the purpose – such entities process your data on the basis of an agreement concluded with us and only in accordance with our instructions, pursuant to the requirements of Article 28 of the GDPR. Personal data may also be disclosed to entities authorised to receive such data under provisions of law. In the event of consent to participate in future recruitment processes, the Controllers will consider your candidacy in other recruitment processes which they conduct – both future and ongoing in parallel. Where the recruitment is conducted on behalf of another entity, your CV may be made available to a third party, but only with your consent.
  5. We would like to inform you that in connection with the processing of your data by us, you have the right to access the content of your personal data, as well as the right to rectification, erasure, restriction of processing, the right to data portability, and the right to object to the processing of your data. To the extent that we process your data based on your consent – you have the right to withdraw your consent to data processing at any time; however, this remains without effect on the lawfulness of the data processing carried out based on the consent prior to its withdrawal. You can withdraw your consent by sending a statement of withdrawal of consent to our correspondence address or to our e-mail address provided in point 7.

  8. Should you consider that the processing of your personal data infringes the provisions of the GDPR, you have the right to lodge a complaint with the President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych).
  9. The provision of personal data by you within the scope arising from the provisions of the Polish Labour Code is mandatory, while in the remaining scope it is voluntary and results from the consent given by you to the processing of the data. The consequence of your failure to provide the data will be the inability to participate in the recruitment process for the position to which you are applying.
  10. Your personal data will not be transferred to third countries or international organizations.
  11. Your data will not be processed in an automated manner, including in the form of profiling, which means that no decisions producing legal effects in relation to you or similarly significantly affecting you will be based solely on the automated processing of personal data, nor will they entail any such automatically made decisions.
